Terms and Conditions for this Raffle
Raffle of SEMOS on the occasion European Youth Olympic Festival (EYOF 2023)
- Organizer
The organiser of the Raffle (hereinafter referred to as “Promotion”) is SEMOS d.o.o.,
Opekarniška cesta 15a, 3000 Celje (hereinafter referred to as the “Organizer”).
- Participation
2.1 Only persons who participate at European Youth Olympic Festival Maribor 2023 can be eligible participants in the raffle.
2.2 The competition will take place from 23.07.2023 until 29.07.2023 at 11:59 pm (“Promotion Period”). Participation is only possible during the Promotion Period. Late entries, regardless of the reason, cannot be considered for the Promotion.
2.3 Participation in the Promotion is free of charge for eligible participants. Participants must enter their data on the website https://info@semos.si/raffle-EYOF-2023 within the Promotion Period. Multiple entries are allowed. Participation does not entitle participants to a prize. The acquisition of additional products and services from the organiser does not increase the chances of winning and does not influence the outcome of the raffle.
2.4 The winner will be randomly selected and subsequently contacted by email. The winner must provide their full name and valid address by email until 29.07.2023.
2.5 The prize will be forfeited if the winner does not respond to the prize notification by 01.08.2023. The prize will also be forfeited if the winner cannot be reached by email, if the provided address is incorrect, or if the prize cannot be delivered for any other reason attributable to the winner.
- Prize
3.1 The prize is a NOVAFON power, including a charging station valued at €449.00, including VAT. Further information about the prize can be found at https://www.semos.si/izdelek/novafon-power-vkljucno-s-polnilno-postajo/ or https://novafon.com/de/das-novafon-power-ladestation. There is no right to receive a cash alternative, exchange, or subsequent modification of the prize. The prize is non-transferable.
3.2 The delivery of the NOVAFON will be made by postal service after the winner has provided their address to the organiser via email. The postal arrangement will be made between the organiser and the winner. The prize will only be shipped to participants within European Union. Once the prize has been handed over to the shipping service provider, the risk of accidental deterioration and loss passes to the winner. If the winner comes outside of European Union and unanticipated tax and customs costs arise, the winner must take care of them.
- Data Protection
The provision of the following personal data is necessary to participate in the raffle: name, email, and professional occupation. This data will be processed exclusively for the purpose of conducting this raffle and fulfilling the prize promise (prize fulfilment). The data processing is based on Art. 6(1)(b) of the GDPR. Only if you also provide your email address and give your consent (Art. 6(1)(a) of the GDPR) by checking the corresponding checkbox we will process your data for advertising purposes. The accounting-relevant data of the winners will be stored for a period of ten years to comply with legal retention obligations. In all other respects, we will delete the participant data after the prize has been handed over. If you have given your consent for the use of data for advertising purposes, they will be deleted immediately after revocation. You can revoke your consent by sending an email to info@semos.si.
The organiser is responsible for processing your personal data. SEMOS d.o.o. provides the landing page through which participation in the raffle is possible. The implementation of the competition and the subsequent use of data for promotional purposes, if consented to, is the responsibility of SEMOS d.o.o.
You have the right to request information from the organiser about your stored data at any time and, if the corresponding conditions are met, to have them corrected or deleted or to restrict their processing. If you believe your data is being processed unlawfully, you also have the right to complain to a data protection supervisory authority.
- Liability and Warranty
5.1 The organisers are not liable for damages resulting from the impairment of the availability of the prize. They also do not assume liability for data losses, especially during data transmission, and other technical defects to the extent permitted by law.
5.2 The organisers do not assume liability for errors or misprints or for any damages that may arise in connection with the provision and use of prizes. These limitations of liability do not apply in cases of wilful intent or gross negligence on the part of the organisers, in cases of mandatory legal liability, or in cases of bodily injury caused by negligence. Participants are obliged to take reasonable measures to prevent and mitigate damages. The organisers are not liable for losses, failures, or delays caused by circumstances beyond their control.
- Miscellaneous
6.1 The raffle may be changed, extended, or terminated prematurely at any time without prior notice and without giving reasons. The organisers do not guarantee missed opportunities to win.
6.2 The terms and conditions may be changed by the organisers at any time without prior notice and without giving reasons.
6.3 The organisers reserve the right to exclude participants who provide false information in the context of the raffle, violate the terms and conditions, manipulate or attempt to manipulate the competition or allow others to do so. The organisers also reserve the right to exclude individuals suspected of using unauthorised aids in participating in the competition or attempting to gain advantages for themselves or third parties through manipulation, violating the terms and conditions or good practices, or otherwise trying to influence the raffle in an unfair or improper manner. In these cases, the refusal of an already promised prize and the recovery of the prize are possible.
6.4 Multiple or simultaneous participation of a person in the competition using pseudonyms or through third parties or any other use of unauthorised aids to manipulate the competition can also lead to the exclusion of the participant. The required information for participation must be provided truthfully. Multiple entries in the form of identical duplicates are excluded and will be removed before the drawing. The organisers expressly reserve the right to remove duplicate postings and/or identical duplicates at any time without prior notice.
6.5 For all legal relationships between the participant and the organiser, the law of the Republic of Slovenia applies exclusively. The legal recourse is excluded.
6.6 The prize is neither exchangeable nor transferable.
6.7 Should the organisers be unable to provide the prizes for unreasonable reasons, they reserve the right to provide an equivalent replacement.
6.8 Participation or any prize cannot be combined with other promotional activities by the organisers.
6.9 These terms and conditions, including the mechanics of the competition, constitute the final provisions for the Promotion. If individual provisions of these terms and conditions are invalid or become invalid, the validity of the remaining terms and conditions remains unaffected.
Note on Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR platform), which can be accessed at https://ec.europa.eu/consumers/odr. We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board and cannot offer participation in such a procedure.
